1. Acceptance of Terms

By accessing or using Dard AI ("the Service," "Platform") at dard-ai.vercel.app, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the platform, including visitors, registered users, and clinic partners.

2. Description of Service

Dard AI provides an AI-powered wellness platform that helps individuals:

• Assess flare risk for chronic conditions using our Dynamic Flare Risk Scoring (DFRS) algorithm
• Analyze self-reported symptoms to identify potential patterns
• Generate informational health reports for personal wellness tracking

The Service uses the Anthropic Claude API to process anonymized symptom inputs and generate responses.

3. Medical Disclaimer — Critical

Dard AI is NOT a medical device, diagnostic service, or healthcare provider. The following apply without exception:

• DFRS scores, symptom analyses, and condition suggestions are for informational and wellness purposes only
• No output from Dard AI constitutes a medical diagnosis, prognosis, or treatment recommendation
• Dard AI does not create a patient-provider relationship between you and Dard AI or any affiliated person
• You should always consult a licensed healthcare professional before making any medical or health decision
• Do not delay seeking medical care based on information from this platform
• In a medical emergency, call 911 immediately — do not use this platform

The DFRS algorithm is a wellness scoring tool inspired by validated clinical risk frameworks, but has not been cleared or approved by the FDA or any regulatory body as a medical device.

4. Eligibility

• You must be at least 18 years of age to use the Service
• You must have the legal capacity to enter into a binding agreement
• The Service is available in the United States and internationally, subject to local laws

5. User Responsibilities

By using Dard AI, you agree to:

• Provide accurate symptom information to receive meaningful outputs
• Not submit other individuals' health information without their explicit consent
• Not use the platform for any unlawful purpose
• Not attempt to reverse-engineer, scrape, or extract the DFRS algorithm or AI models
• Not use outputs from this platform to make clinical decisions for others without professional oversight
• Understand and accept that outputs are informational, not diagnostic

6. Intellectual Property

All content, features, and functionality of Dard AI — including but not limited to the DFRS algorithm, scoring methodology, user interface, branding, and written content — are the exclusive property of Manjeet Singh / Dard AI and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from any part of the platform without prior written consent.

Reports generated for your personal use may be saved and shared with your healthcare provider. Commercial use of outputs is prohibited.

7. Privacy and Data

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:

• We do not permanently store your identified health inputs
• Symptom data is processed anonymously through the Anthropic Claude API
• We do not sell your data to third parties
• We comply with applicable California privacy law (CCPA)

8. Limitation of Liability

To the fullest extent permitted by applicable law, Dard AI, its founders, employees, and affiliates shall not be liable for:

• Any medical decisions made based on platform outputs
• Inaccuracies in symptom analysis or DFRS scores
• Indirect, incidental, or consequential damages arising from use of the Service
• Loss of data, revenue, or business opportunities
• Any harm resulting from reliance on platform outputs instead of professional medical advice

Our total liability to you for any claim arising from use of the Service shall not exceed $100 USD.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• DFRS scores or symptom analyses will be accurate or complete
• The platform will meet your specific health or wellness needs

10. Third-Party Services

Dard AI integrates with third-party services including Anthropic (AI analysis) and Vercel (hosting). We are not responsible for the availability, accuracy, or privacy practices of these services. Use of Dard AI constitutes acceptance of their respective terms.

11. Clinic and Partner Terms

Healthcare providers, clinics, or organizations accessing Dard AI for patient support must:

• Enter into a separate Clinic Partner Agreement prior to deploying Dard AI to patients
• Ensure their own HIPAA compliance obligations are met independently
• Not represent Dard AI as an FDA-cleared diagnostic tool to patients
• Ensure patients understand the informational nature of the platform

12. Termination

We reserve the right to suspend or terminate access to the Service at our discretion, including for violation of these Terms, misuse of the platform, or for technical or business reasons. You may stop using the Service at any time.

13. Governing Law

These Terms shall be governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Santa Clara County, California.

14. Changes to Terms

We may update these Terms as the platform evolves. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will update the "Last updated" date above when changes are made.
